Is a woman guilty of paternity fraud if she puts the wrong man's name on her child's birth certificate? And should that man then be responsible for paying child support? Voice your opinion.

In my opinion, yes. If the man didn't agree to putting his name on the birth certificate, and she did it so he'd believe he fathered the child, that is fraudulent and unconscionable.

As for the man who was the victim having to pay support?
Hell, no.

I'm not a lawyer, but if she does it knowingly, that sounds illegal to me. And if the guy is being fooled into thinking he's the father when he isn't, then no, of course he shouldn't.

If she does it knowing that someone else was the father of the child, yes, she is guilty of fraud. No way should the man be responsible for child support based on somebody's say-so - that's what DNA tests are for.

She should, and some states are changing policies to safeguard against that issue.

Our state will not let you name a father on the birth certificate unless you are married to the father.

If you are unmarried, you need
written forms filled out by dad acknowledging paternity before they will issue a certificate naming a dad.

hell yes she is. and he should sue her ass for it. if women arent ready to support kids they should keep thier legs closed until they re with someone who is man enough to provide for them and the child and/or invest in either a mornign after piss or an abortion. every day we hear about some dead beat who got some goofy wench pregnant and walked on her and you never hear how she was JUST as much at fault as he was. maybe women should spend a little more time using thier brains before they get on thier backs.

Yes, the woman is guilty to paternity fraud and the man should not have to pay child support for a child that's not his.

I believe that any time a child is born outside of marriage and the woman files for child support, the paternity test should show that a man is indeed a child's father before he has to pay child support. But, if a man doesn't take the paternity test within, say, 3 months from the date he's requested to take it, then he should have to pay support.

If the woman put down the wrong man as her childs father, purposely, just so there would be a name their, because she didn't really know who the father was, then, I feel that she would be guilty of paternity fraud. That man should insist on a paternity test, to rule out whether he is or is not the child's father. If he is not, then he does not have to pay child support.

I knew a woman who did this. It turned my stomach, especially because she decided for the poor slob she put on there that he was going to be a father. Her whole attitude about it was so matter-of-fact, and thoughtless. We argued over it several times. It finally ended our friendship.
