A Thinker (Female, 26-28) asked:

I was wondering if anyone knows about child support. If a father gives up rights to the mother of their child and allows her to change the childs last name. Does he still owe her child support?

I had always thought the father was required to pay support whether he gave up his rights to the child or not. Answerologists on the site said it is different in some states. You need to check with a lawyer on your personal laws for your country or state or province. Rosey

if there is a legal name change and this 'giving up rights'...which sounds alot like relinquishing...or giving up as in adoption, then no....no obligation. Why were the rights given up anyways, for your purpose or for his?

Did you do it with a lawyer! If you did then he does not have to pay child support BUT if it isnt done with a lawyer that you BOTH SIGNED then he owes you child support!

That is normally dependent upon state law. Usually, child support runs until the child becomes an adult or is adopted.

The only way that he wouldn't have to pay child support is if the relinquishing of his rights is done with a lawyer and is notarized with a lawyer's signature. Otherwise he will continue to have to pay child support...:)
